Mr. Patni, learned counsel appearing on behalf of the petitioners submits that with efflux of time and since suit is already decided and appeal against the same is pending, petition has become infructuous. He, however, requests to to keep all the points taken in this petition open to be taken in the appeal. 2.
Writ petition as such stands disposed of as infructuous. Needless to say that all points, including those canvassed in writ petition before this court, would be open to be taken in the appeal.
