Heard the learned counsel for the petitioner. He submits that original borrower has cleared the account and nothing is remained to be recovered. The petitioner was a guarantor. However, as per the Court's order, he has deposited Rs.40,000/- as condition for stay, in the year 2010. Since the borrower paid entire amount, nothing remained in this petition. Hence, leave granted to withdraw the petition. However, the ofÏce is directed to refund the amount of Rs.40,000/- with accrued interest, if any, to the petitioner.

In view of the above, the writ petition stands dismissed. 3.
Rule stands discharged.
