Heard learned Counsel for the parties.

The dispute is regarding apportionment of the compensation in respect of land G. No.753, situated at Sangvi (Kati), Taluka Tulzapur, District Osmanabad.

{2} wp171821.odt The learned Counsel for the parties submitted that already a Reference for apportionment of the compensation is pending before the competent Court at Osmanabad, in which the petitioner is one of the parties. It also transpires that the petitioner has raised the issue of amount of compensation of Rs.83,694/- which was earlier paid to Respondent No.2.

In such circumstances, it is evident that the Reference Court will have to consider the issue of apportionment of compensation looking to the total compensation awarded and paid to the parties.

With this, the petition is disposed of.
