This is an application for bail under Section 439 of the Code of Criminal Procedure. The applicant has been arrested in connection with Crime No.0737/2022, registered at M.I.D.C. Waluj Police Station, District Aurangabad, for the offences punishable under Sections 21(b), 20(b) of the N.D.P.S. Act. 2.

Heard. Perused the First Information Report (FIR) and related papers.

The applicant was found in possession of Ganja. The Ganja was also found stored at her residence. The record however

(( 2 )) 951-BA-1591-2022 indicates the total Ganja seized from her is less than commercial quantity. Rigours of Section 37 of the N.D.P.S. Act is therefore not applicable. The applicant is a woman. She has no criminal antecedents. She is in jail for little over 11⁄2 months. In the fitness fot hings, the application is allowed in terms of following order:

O R D E R

(i) The Bail Application is allowed.

(ii)The applicant be released on bail in connection with Crime No.0737/2022, registered at M.I.D.C. Waluj Police Station, District Aurangabad, for the offences punishable under Sections 21(b), 20(b) of the N.D.P.S. Act, on her executing P. R. bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand) with surety bond of the like amount.

(iii)The applicant shall not indulge in similar offences. (iv)The applicant shall not tamper with the prosecution evidence.
