Heard learned counsel for the applicant and the learned APP for the respondent-State.

The applicant is apprehending arrest in connection with FIR No.0199/2024, dated 01/08/2024, registered at Lohara Police Station, District Osmanabad, for the offences punishable under sections 105 of the Bhartiya Nyaya Sanhita.

This Court granted interim protection to the applicant by order dated 04/09/2024, and the applicant thereafter has cooperated with the investigation. The case against the applicant is that on 23/07/2024, at 11:00 a.m. when the father of the informant had gone to the field to cut grass, he had been electrocuted. The applicant, who is the owner of the neighboring field, had allegedly drawn the wire from common bandh (embankment) for operating an electric pump motor. While cutting grass, the wire was accidentally severed by the scythe, leading to the electrocution of the informant's father, who was declared dead at the 1 of
945 ABA 1503-2024 hospital shortly thereafter.

The learned Counsel for applicant submits that, the applicant has cooperated with the investigation since being granted interim protection. It is further submitted that the drawing of the wire from the embankment was within the knowledge of all as the same was used for pumps installed at the common well. Prima facie, the death is accidental and not homicidal. Custodial interrogation of the applicant is not necessary.

In view of the above, the interim protection granted to the applicant is confirmed, and the application is allowed in the following terms : - i] In the event the applicant is arrested in connection with FIR No.0199/2024, dated 01/08/2024, registered at Lohara Police Station, District Osmanabad, for the offences punishable under sections 105 of the Bhartiya Nyaya Sanhita., he shall be released on bail on furnishing PR bond of Rs.20,000/- with one or two sureties in the like amount to the satisfaction of the trial Court. ii] The applicant shall attend the police station as and when called by the police.
iii] The applicant shall not tamper with the evidence of the prosecution in any manner. He shall not influence the informant, 2 of
945 ABA 1503-2024 witnesses and other persons concerned with the case. iv] The applicant shall co-operate with the investigation and also in the proceedings before the trial Court. 6.
In the event, the applicant violates any of the conditions specified in this order, it shall be liable to be cancelled. 7.
It is also clarified that the observations made in this order are limited to the disposal of the present anticipatory bail application and the trial Court shall proceed further in the matter without being influenced by the observations made hereinabove. 8.
The application stands disposed of.
