Mr.Shah, learned counsel submits that after the order is passed by the Executing Court, the petitioner has got the Succession Certificate and has produced it before Executing Court. The Executing Court has accepted the said certificate and the matter is proceeded further by the Executing Court.

In view of the above, learned counsel for the petitioner seeks leave to withdraw the Writ Petition with liberty to agitate afresh if the occasion arises.
