PER COURT :- We had heard the matter on the last date. We had expressed that the Municipal Council had deviated from the terms and conditions. Respondent No.4 might not have sufficient funds in the accounts and probably for that reason, the Municipal Council did not present the cheque for one month. We had asked the learned Advocate for the Municipal Council as to what steps the Municipal council proposes to initiate. The learned counsel submits that he has received communication from the Chief Officer, Nagar Parishad that fresh tenders would be issued for the weekly market. The same would be placed in the general body for approval and 20 - 25 days would be required.

{2} wp 10506.19.odt In the light of the communication that fresh tenders would be issued, we direct respondents to issue fresh tenders preferably within six weeks from today. Till the fresh tender is finalized, respondent No.4 may proceed and perform the work as has been done pursuant to the earlier tender process which would be rescind by the Municipal council by initiating fresh tender. The same shall be as a stop gap arrangement. Writ petition is disposed of. No costs.
