By these applications, the applicants seek their release on prearrest bail, in connection with C.R. No.I-231 of 2015, registered with M.I.D.C. Walunj police station, for offences punishable under sections 399 and 402 of the Indian Penal Code.

According to the applicants they are falsely implicated in the crime and have no role to play in the commission of the alleged crime. 3.

Learned Addl. Public Prosecutor, while opposing the applications, has taken me through the investigation papers, so also the conduct of the present applicants. From the record, it appears that the other accused person, namely, Chand Pasha Banu Shaikh was arrested on the spot on 17th August, 2015, from whom material was seized in the commission of the crime in question.

Upon perusal of the investigation papers, there appears to be prima facie involvement of the present applicants in the commission of the crime in question. In view thereof, this Court is not inclined to release the applicants in the event of their arrest.
