IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD ANTICIPATORY BAIL APPLICATION NO.1276 OF 2022 VAIBHAV CHANDRAKANT PACHARANE AND ANOTHER

VERSUS

THE STATE OF MAHARASHTRA ...

Advocate for Applicants : Mr. R. S. Shinde h/f. Mr. V. P. Latange APP for Respondent : Ms. V. S. Choudhari ...

CORAM :

S. G. MEHARE, J.

DATE :

06-10-2022 PER COURT :- 1.

After hearing the learned counsel for the applicants, the Court questioned him about the change in circumstances after rejection of Anticipatory Bail Application No. 1067 of 2020 by this Court. He would submit that non filing of the charge-sheet is the change in circumstances. Suddenly, after 2020, the applicant again approached the Sessions Court seeking same relief which was declined by this Court. Leave to withdraw the application was granted unconditionally. However, no liberty was granted to the applicant. This appears nothing but filing an application for the same relief after rejection of earlier application. The reason is best known to the applicant, why the application was filed after rejection of the application of bail. However, there is no change in circumstances as alleged by the learned counsel for the applicant.

923-ABA-1276-22.odt Hence, the Court expressed disinclination to grant anticipatory bail on merit.

2.

The learned counsel for the applicants, on instructions, seeks leave to withdraw the application. Leave granted to withdraw the application without liberty to file fresh application before the learned Sessions Court, unless permitted by law. The application stands dismissed as withdrawn unconditionally. ( S. G. MEHARE ) JUDGE rrd
