Heard both the sides. The learned counsel for the applicants submits that, the bread winner of the family met with an accidental death. The learned counsel for the respondent-insurer submits that, the applicant-original claimants failed to prove the employer-employee relationship and the Commissioner has awarded an exorbitant amount of compensation ignoring the wages of deceased.

In view of the above submissions and considering the challenge made to the judgment and order passed by the Commissioner, the applicants are permitted to withdraw 60% of the amount deposited before the Commissioner on furnishing undertaking to the satisfaction of the Commissioner. Civil application is accordingly disposed of.
