The Applicant is apprehending arrest in Crime No. 0107/2025, registered with Mukramabad Police Station, District Nanded, for the offences punishable under Sections 189(2), 191(2), 191(3), 190, 118(2), 118(1), 115(2), 352, 351(2) of the BNS, 2023, which is registered on the report lodged by the mother of Applicant and, therefore, filed this application under Section 482 of the BNSS. 3.

The case of prosecution is that the informant has two sons by name Balaji and Ram (Applicant) and one daughter Usha. Informant cultivate the agricultural field. The Applicant and his wife claims that the said land belongs to them and asked the informant not to cultivate the land. On 15.06.2025, at 7.00 am., the FIR named accused including the Applicant picked a quarrel with informant and the other witnesses

and assaulted them by stick, hands and fists blows. Some of the witnesses suffered injuries.

Out of the said incident dated 15.06.2025, the Applicant has lodged report with the same police station and Crime bearing No. 0103/2025, came to be registered against eight persons including the injured Balaji for the offences punishable under Sections 189(2), 191(2), 191(3), 190, 118(2), 118(1), 352, 351(2) of the BNS, 2023. This shows discord between the families. This Court in ABA No. 1219/2025 by order dated 16.07.2025, granted Anticipatory Bail to the witness Balaji. In the present Crime, the role attributed to the Applicant is, assault to Balaji by stick. There is nothing to show that the MLC was registered and any injury was suffered by Balaji. All the other FIR named accused persons are granted protection by the learned Sessions Court. Considering these aspects, who was the aggressor would be decided in the trial. Considering all the above aspects, the possibility of exaggerated version by the informant in the present crime cannot be ruled out. In this view of the matter, I am inclined to pass the following order :

ORDER

i.

In the event of arrest of the applicant, he shall be released on bail on executing P.R. bond of Rs. 15,000/- (Rupees fifteen thousand) with one surety in the like amount.

ii.

Applicant shall attend the concerned police station as and when called.

iii.

Applicant shall not tamper the evidence or influence the witnesses in any manner.

iv.

Anticipatory Bail Application stands disposed of.
