The applicant is apprehending arrest, in connection with C.R. No.48 of 2015, registered with police station, Shiradhon, Dist. Osmanabad, for offence punishable under section 39 of the Maharashtra Money Lending (Regulation) Ordinance, 2014.

By an order dated 16th September, 2015, taking into consideration the factual matrix of the case, this Court has extended interim protection to the applicant.

Mrs Deshpande, learned Addl. Public Prosecutor appearing on behalf of the respondent has strongly opposed grant of bail, in the event of arrest of the applicant, on the ground that there is prima facie involvement of the applicant in the commission of the crime in question and the crime is registered after inquiry in the matter.

In my opinion, no fruitful purpose will be served by granting custodial interrogation of the applicant, for registration of the sale deed in 1984. In view thereof, it will be appropriate to confirm the interim protection granted to the applicant, on the same terms. Thus, following order :- In the event of arrest of the applicant, in connection with C.R. No.48 of 2015, registered with police station, Shiradhon, Dist. Osmanabad, for offence punishable under section 39 of the Maharashtra Money Lending (Regulation) Ordinance, 2014, he be released on bail, on furnishing P.R. Bond of Rs.10,000/- with one surety in the like amount. The applicant shall co-operate in the matter of investigation.
