In all these matters, the validation proceedings in respect of caste/tribe claims of the petitioners are pending with the respondent/Committee.

Mr. Vibhute, the learned counsel for petitioners submits that, the petitioners have been given admission to the Ist year M.B.B.S./B.D.S./Physiotherapy/B. Sc. Nursing courses conducted by the Maharashtra University of Health Sciences Nashik. The respondents are not permitting the petitioners to prosecute their further studies and appear in the examination only on the ground that validation proceedings are pending. 3.
We have heard the learned counsel for respective

In view of the fact the validation proceedings in respect of caste/tribe claims of the petitioners are pending, we pass following order.

The Scrutiny Committee shall decide the validation proceedings in respect of caste/tribe claims of the petitioners expeditiously and preferably within a period of nine (09) months from today. The petitioners shall co-operate in expeditious disposal of the said proceedings. The petitioners shall appear before the Committee on 22nd November, 2017.

The petitioners shall file an undertaking with the respective institutions that, in case their caste/tribe claims are invalidated, then they would pay the full fees for the period they have undertaken the course. The respondent/institutions can take further course of action against the petitioners in pursuance to the judgment that would be delivered by the Committee in the validation proceedings. Till the validation proceedings are decided, the respondents shall not refrain the petitioners from prosecuting their studies and from appearing in the examination and declaration of results, if they are otherwise eligible. The writ petitions are disposed of. No costs.
