3] In case the application filed by the petitioner under Section 28A of the Land Acquisition Act (Exhibit 'B' page 20) is still pending, then respondent No.2 shall decide the said application, on its own merits, in accordance with law, after hearing all concerned, expeditiously and preferably within 9 months.
