The Petitioner has been appointed as a Stenographer-Lower Grade recently by order dated 26.02.2024, issued by Respondent No.3. The post was reserved for a Scheduled Tribe category. The Petitioner claims to be Koli Mahadev-29 Scheduled Tribe. His claim for seeking a validity certificate is pending since 14.05.2024, with the Committee. He is apprehending termination since the validity certificate will have to be tendered within six months from the date of joining. To show his bona fides, the Petitioner has tendered an affidavit undertaking dated 30.08.2024, stating therein that his service may be protected until the claim is validated and he would not seek regularization, increment, promotion, service benefits etc. until his claim is validated. The said affidavit undertaking is marked as 'X', for identification.

The learned AGP submits that the claim of the Petitioner would be decided by 31.05.2025.

The Petitioner is on probation. In view of the affidavit Annexure-X, we direct that his service as a probationer shall not be terminated by Respondent No.3, only for the reason that his validity certificate is not submitted. Until then, he would continue on probation and the statement made in the affidavit undertaking would bind him before the Committee as well as before this Court, if his claim is invalidated and he is required to rush to this Court.
