Dhanashri Balaji Wantekar And Another v. The State Of Maharashtra Through Its Secretary And Another
2025:BHC-AUG:22853-DB
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD WRIT PETITION NO. 10451 OF 2025 Dhanashri Balaji Wantekar & Anr.
...Petitioners
Versus
The State of Maharashtra & Anr.
...Respondents
*** Mr. Thorat Mohanish V., for Petitioner.
Mr. S. V. Hange, AGP for Respondents.
*** CORAM : MANISH PITALE AND Y. G. KHOBRAGADE, JJ.
DATE : 21st AUGUST 2025.
P. C. :
1.
Heard learned counsel for the petitioners.
2.
This petition is filed on 19th August 2025 i.e. the day before yesterday, praying for a direction to the respondent No.2 - Scrutiny Committee to decide their tribe claims by tomorrow i.e. 22nd August 2025. The ostensible reason for such extreme urgency is that college has been allotted to the petitioners in the Central Admission Process round under NEET-UG 2025.
3.
It is to be noted that these very petitioners filed Writ Petition No. 5366 of 2025, before this Court seeking similar direction to the Scrutiny Committee and the said petition was disposed of granting them liberty to submit an appropriate application making out
exigency for early decision of their claims before the Scrutiny Committee.
4.
The most crucial fact in the present case is that, admittedly the petitioners moved their application / proposal for grant of tribe validity only in March 2025. The family of the petitioners and the petitioners themselves were clearly aware about their claim of belonging to the Scheduled Tribe "Koli - Mahadev" and yet, no steps were taken till March 2025, to get their tribe claims verified by the respondent No.2 - Scrutiny Committee.
5.
Mr. Hange, learned AGP appears for both respondents. The learned AGP, on instructions, submits that since the application / proposal itself was moved in March 2025, presently it is not clear as to what is the status of the proceedings before the Committee, although the learned counsel for the petitioners claims that the vigilance cell enquiry has been completed.
6.
Considering the aforesaid conduct of the petitioners, we are inclined to dispose of this petition by only directing the respondent - Scrutiny Committee to decide the tribe claims expeditiously. 7.
Accordingly, the petition is disposed of by directing
respondent No.2 - Scrutiny Committee to decide the tribe claims of the petitioners, as expeditiously as possible, upon considering the urgency being projected on behalf of the petitioners. (Y. G. KHOBRAGADE, J.) (MANISH PITALE, J.)
