IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD CIVIL APPLICATION NO. 10550 OF 2024 IN WP/10079/2021 Shrikant Vishwambhar Deshmukh

VERSUS

The State Of Maharashtra Through Its Secretary And Others ...

Advocate for Applicant : Mr. Salgare Vitthal G. AGP for Respondent/State : Mr. S.S. Dande ...

CORAM : S.G. MEHARE & SHAILESH P. BRAHME, JJ.

DATED : JANUARY 24, 2025 PER COURT :

1.

Heard the respective counsels.

2.

This is a good example of lethargy on the part of the lawyer in not removing the office objection for 840 days. No cognizance was taken of the order by which this writ petition was dismissed for non-removal of office objection. We are satisfied that the client is not at fault. The petitioner is a pensioner. 3.

To make the justice with the petitioner who is a pensioner, we allow this application on the voluntary statement of the learned counsel for the petitioner that he is ready to Rs.5,000/- from his pocket with the Registrar (Judicial) of this Court within two weeks from today. After producing the receipt of deposit, the writ petition be restored to its original position. The petitioner has already removed office objections in advance as per the Court's order.

In above terms, the civil application stands allowed. (SHAILESH P. BRAHME, J.) (S.G. MEHARE, J.) Mujaheed//
