None appears for the petitioner. On 3rd September, the matter was adjourned at the request of the petitioner. Mr. Kulkarni, the learned counsel for the Corporation made a statement that respondent no.3 is not a selected candidate and selected candidate is Mr. Kirtikumar P. Kolhe and that person was issued with Letter of Intent and he has commenced his retail outlet.

No steps are taken by the petitioner. The petition cannot be heard and decided in absence of the selected candidate.

In light of above, the writ petition is dismissed for non prosecution.
