PER COURT :

1] Mr.Kulkarni, learned counsel states that, the post of Sarpanch of Gram panchayat Malane, was reserved for Scheduled Caste (Woman) category. However, the same is subsequently changed to Other Backward Class category on the basis of the judgment of this Court in Writ Petition No.8610 of 2015, dated 24th August, 2015 which

915 sr. no..doc - 2 - is passed in respect of reservation of another Grampanchayat. However, the judgment of this Court in Writ Petition No.8610 of 2015 is set aside by the Apex Court. As such, the reservation of Grampanchayat, Malane, should also be restored to Scheduled Caste (Woman) category.

2] Mr.Phule, learned Assistant Government Pleader states that, he has received communication from the Collector, Dhule stating that, it would be appropriate to reserve seat of Sarpanch of village Grampanchayat, Malane, for Scheduled Caste (Woman) category. 3] Considering the aforesaid conspectus of the matter the reservation of Grampanchayat of Malane, for the post of Sarpanch as fixed by the impugned communication is set aside and as suggested by the Collector, Dhule,the post of Sarpanch for Grampanchayat, Malane, is reserved for Scheduled Caste (Woman) category. 4] Writ petition is accordingly disposed of. No costs.
