Learned advocates for the litigating husband and wife in this petition submit that this petition be allowed by consent as both the parties are not willing to proceed with the settlement terms arrived at in mediation in H.M.P. No. 614/2013, H.M.P. No. 197/2011 and H.M.P. No. 263/2014.

Shri Patil, learned advocate for the respondent / wife submits that the demand draft for Rs. 3,00,000/- (Rupees Three Lakhs only), which amount the respondent had received from the petitioner, can be handed over to the learned advocate of the husband in Criminal Writ Petition No. 1608/2015.

Both the learned advocates jointly submits that the settlement is being withdrawn between the parties by consent. 4.
In the light of the above, this petition is partly allowed in terms of prayer clause 'B' and H.M.P. No. 614/2013 stands restored to the file of the learned Civil Judge Senior Division, Jalgaon.

Both the learned advocates agree that the Writ Petition (R.C. No. 1166/2015) i.e. Writ Petition Stamp No. 18561/2015, can be restored by allowing C.A. No. 11542/2016. For the said purpose both the learned advocates would approach the appropriate bench of this Court before which the said petition filed by the respondent / wife would be considered and both the parties would seek the restoration of H.M.P. No. 197/2011, by consent before the said Court.
