DATED : 12th MARCH, 2015 P.C. :- Heard Mr.Talekar, learned counsel for the petitioner, Mr.Choudhari and learned AGP for respondent State. 2] The learned counsel for the petitioner on instructions states that now Petition is restricted only to the extent of salary and the same is also recorded vide order dated 4/12/2014 and leave is granted to the petitioner to file separate petition seeking relief of absorption etc.

3] The petitioner claims arrears of salary from August, 2013 till the admissible claim. The same involves disputed questions of facts.

wp8753,8781-13 -2Even as per the M.E.P.S. Rules, more particularly Rule 7, pay scale and allowances can be determined by Deputy Director of Education. 4] In light of that, petitioner may make appropriate application/claim to respondent no.4 regarding the claim of arrears of salary. The respondent no.4 on receipt of the said application/claim shall decide the same on its own merits expeditiously after hearing petitioner as well as the respondent institution and college expeditiously preferably within six months from the date of receipt of application/claim.

5] Writ Petition is disposed of. No costs.
