This is yet another case of an Education Officer passing an order on 21.04.2023 relying upon the Government Circular dated 01.12.2022 which was stayed by this Court at Nagpur on 21.12.2022 in WP No.8215/2022 (Friends Social Circle, Akola and others Vs. State of Maharashtra and others). Vide judgment dated 21.07.2023, the said Petition alongwith a group of Petitions, have been allowed and the circular dated 01.12.2022 is quashed and set aside. khs/Sept.2023/10978

In view of the above, this Petition is partly allowed. The impugned order dated 21.04.2023 is quashed and set aside. The proposal of the Petitioner is restored to the file of Respondent No.2 to be considered afresh in the light of Rule 41A of the MEPS Rules, 1981 within 45 days from today.
