This is an application for granting of regular bail under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023, in connection with Crime No.102 of 2025, registered at Deoni Police Station, District Latur, for the offences punishable under Sections, 74, 75 and 351(2) of the Bhartiya Nyaya Sanhita, 2023 and Sections 8, 10 and 12 of the POCSO Act.

The learned advocate for the applicant pointed out the report in which the informant averred that on 22.03.2025 at about 12:30 p.m., while his daughter and her two friends were playing under a banyan tree, the applicant came there and took out ten rupees currency note from the informant's daughter and a silver ring from one of the victim children and refused to return them. The applicant told the victims that

(( 2 )) BA NO.1655 OF 2025 he would return their currency note and silver ring if they accompanied him and also offered them sprit cold drink. Thereafter, the applicant took the victims on his motorcycle to a field and gave them sprite to drink. The applicant then showed them obscene videos on his mobile phone. When the minor victims asked the applicant why he was showing such videos, he replied that "everyone is watching and doing this" and asked them to caught hold his private part and to move it. After some time white coloured liquid came out from his private part. The applicant then threatened to kill them if they disclosed the incident and carried them back to the village. The report was lodged after five days of the incident.

The learned advocate for the applicant submitted that the applicant has been falsely implicated in the crime. The applicant is an aged person. He has roots in the society and he will not flee away from the trial. The trial will take long period. The custody of the applicant is not necessary. It is lastly prayed to allow the application. 5.

The learned APP for the State and the learned advocate for respondent No.3 strongly opposed the application. They relied upon the statements of witnesses recorded under Section 183 of the B.N.S.S., wherein the incident has been narrated in detail. It is submitted that the applicant is involved in a serious crime and considering the serious nature of crime, it would not be proper to grant bail to the applicant. It is lastly HRJ

Perused the report, particularly the statements of witnesses. Custodial interrogation of the applicant is not necessary. The applicant has roots in the society and he will not flee away from the trial. Trial will take long period. Considering the nature of offence, the application deserves to be allowed subject to certain conditions. Hence, the following order: ::ORDER::

I.

The application is allowed.

II.

The applicant, in connection with Crime No.102 of 2025, registered at Deoni Police Station, District Latur, for the offences punishable under Sections, 74, 75 and 351(2) of the Bhartiya Nyaya Sanhita, 2023 and Sections 8, 10 and 12 of the POCSO Act, be released on bail on furnishing personal bond of Rs.25,000/- with one surety of the like amount on following conditions:- a) The applicant shall not tamper with the prosecution evidence and shall not pressurize the witnesses, in any manner. b) The applicant, except on the date fixed for hearing of the trial, shall not enter in Village Bombali (Bk), Taluka Deoni, District Latur, till the conclusion of the trial.
