The petitioner, on appearance before the trial court in the pending suit, is always at liberty to take recourse to the various provisions under the C.P.C., including the provisions of Order 7 Rule 11 for rejection of plaint and in the event such application is moved by the present petitioner, it is for the trial court to decide the same on its own merits in accordance with law.
