IN THE HIGH COURT OF JUDICATURE OF BOMBAY
BENCH AT AURANGABAD 1 WRIT PETITION NO.1664 OF 2019 RAJIV MAROTI SONTAKKE
VERSUS
THE STATE OF MAHARASHTRA AND ANOTHER ...
Mr. V.P. Kadam, Advocate for the petitioner.
Mr. P.S. Patil, A.G.P. for the State.
Mr. S.B. Pulkundwar, Advocate for respondent No.2. ...
CORAM :
S.V. GANGAPURWALA & AVINASH G. GHAROTE, JJ.
DATE :
19th December 2019.
ORDER :- .
The present petition is fled for the same purpose for which earlier Writ Petition No.362 of 2018 was fled. The said Writ Petition was disposed of as withdrawn. The petitioner was granted liberty to follow other recourse as may be permissible in law.
2.
It is clear that this Court was not inclined to entertain the earlier Writ Petition. Now the petitioner claims that subsequent to the order, representation is made. That cannot be a ground to entertain fresh Writ Petition for the same purpose. Father of the petitioner retired and relieved on medical grounds in the year 2004 and
(2) WP-1664.2019.odt subsequently died in the year 2006.
3.
The purpose on compassionate appointment would not survive after such a long slumber. Repeated Writ Petition for the same purpose is not tenable.
4.
Writ Petition is disposed of. No costs.
