Applicant apprehends arrest in C.R. No. 679 of 2023, registered with Shrigonda Police Station, Dist. Ahmednagar for offences punishable under sections 420, 465, 467, 468, 471, 409 read with 34 of the Indian Penal Code.

FIR is lodged by Bharat Gabaji Dhas alleging that applicant in collusion with other accused persons made a forged notary document bearing No. 360/2020 in respect of Gut No. 211, admeasuring 72 Are belonging to informant. For that purpose, stamp paper of Rs. 500/- was purchased from stamp vendor at Yerwada, Pune, in the name of Wasim Shaikh, resident of Wadi, Pune. Seal of notary Shruti Sankpal, Pune is put on the said agreement. Said notary has denied that document is Bhagyawant Punde

{2} 924-ABA-1412-2023 executed by her. 7/12 extract of said land is also forged. 3.

Heard learned advocate for applicants and learned APP for respondent-State assisted by learned advocate for informant. Perused the investigation papers.

Perusal of investigation papers, prima facie, do not show any involvement of applicants in the present crime. Admittedly, forged documents are already placed in the Civil Court, in a civil dispute between family of applicants and informant.

Considering the gender of applicant and as nothing is to be recovered from her and as she has co-operated in the investigation while on interim anticipatory bail, her pre-trial custodial detention is not necessary.

In the result, application is allowed by confirming interim protection order dated 24th August, 2023. 7.

Till filing of charge sheet, applicant shall attend the concerned police station as and when called by investigating officer and shall co-operate in the investigation. Applicant shall not tamper the prosecution evidence.
