Applicant is praying for condonation of delay of 40 days caused in preferring the present first appeal challenging judgment and award dated 14.03.2024 passed by the learned Chairman, Motor Accident Claims Tribunal, Aurangabad in M. A. C. P. No. 343 of 2012.

Learned counsel Mr. Usmanpurkar for the applicant would rely on the grounds mentioned in para Nos. 2 to 6 of the civil application to make out a case for condonation of delay. The averments in the application have not been controverted. It is desirable to condone the delay.

For the reasons stated in the application, the delay is

2 951 ca 9714.24 condoned. The civil application is allowed in terms of prayer clause 'B'. Office is directed to register the first appeal. The civil application is disposed of.
