This application is to bring LRs of sole deceased respondent who died on 14th May, 2004.

Copy of the death certificate filed along with the application confirms the said fact. In spite of service of notice to proposed legal heirs of deceased respondent i.e. respondent nos. 1-A to 1-C, none appears for them. It appears that they have no objection.

Considering the reasons mentioned in the application for condonation of delay, application deserves to be allowed. It does not appear that the delay is deliberate. No prejudice will be 1/2

caused to the other side, if the delay is condoned. 4.

Hence, Civil Application stands allowed in terms of prayer clause 'A to D'.

5.
