Heard learned counsel for the applicant and learned APP for the respondent/State.

Applicant seeks pre-arrest bail in connection with the Crime No. 0312/2019 registered with CIDCO Police Station, Dist. Aurangabad, for the offences punishable under Sections 406, 420 read with Section 34 of the Indian Penal Code, Sections 3 and 4 of Maharashtra Protection of Interest of Depositors Act, Section 66(D) and 67 of the Information Technology Act and Section 4,5(B) and 6 of the Banking Act.

At the outset learned APP submits that the application may be rejected on the ground that since the date of registration of offence the applicant has deliberately kept himself away from the

It is submitted that though he has not been declared as absconding accused but inspite of making persistent efforts to trace whereabouts of the applicant since June, 2019. He successfully avoided to make himself available for investigation. In support of this contention the learned APP has relied on the case diary. I have perused it.

Apparently, the case diary shows the applicant deliberately avoided the process of law and thereby caused serious prejudice to the investigation.

Be that as it may, let the public prosecutor file an affidavit to state the efforts made by the State to trace his whereabouts. Affidavit shall be filed on or before 12-08-2021. 6.
List the application for consideration on 20-08-2021. 7.
