The appellant/applicant has moved this application to bring the legal heirs of respondent Nos. 1 and 2 on record by condoning the delay in filing the said application. 2.

It appears that despite service of notice on the Legal heirs of respondents Nos. 1 & 2, none appeared before the court. It seems that they have no grievance about the contents of the application.

Having considered the reasons disclosed in paragraphs 2 to 5, the application is allowed as prayed for. The delay caused in filing the application to bring the legal heirs of respondent Nos. 1 and 2 on record is condoned. The abatement, if any, is set aside.

The appellant/applicant is permitted to bring the names of the legal heirs of respondent Nos. 1 and 2 on record. The appellant/applicant is directed to carry out the amendment in the appeal memo within two weeks. Upon carrying out the amendment, issue a notice to the legal heirs of respondent Nos. 1 & 2, returnable on 02-12-2025.
