Applicant is I.T. Engineer serving at Pune, initially in Infosys Company, then in Capgemini Company and presently at Zensar Company. He is implicated in Crime No.144/2022, registered with Newasa Police Station, Ahmednagar, for offences punishable under Sections 420, 406, 409, 120B of the Indian Penal Code and Section 3 of the Maharashtra Protection of Interest of Depositors (In Financial Establishments) Act, 1999.

Heard learned advocate for applicant and learned Assistant Public Prosecutor for respondents - State. 3.

Perusal of investigation papers show that accused No.1 Vaibhav Anant Chemte has deceived depositors by accepting huge deposits on the promise of giving handsome returns. Only

2 907-ABA-1279-22.odt allegation against applicant is that he was present along with accused No.1 and other accused persons when accused No.1 convinced the depositors to invest money. Except this, there is no active involvement of applicant seen from investigation papers. There is absolutely no material to show involvement of applicant in the alleged crime.

Accused No.1 is arrested and on completion of investigation charge-sheet is filed against him. All the other accused persons are shown absconding.

Taking into consideration these aspects and the fact that applicant is serving at Pune in I.T. Company, applicant deserves protection. Application is, therefore, allowed in terms of interim order passed by this Court on 28/09/2022.
