We have heard Mr. Dawalkar, the learned advocate for the petitioner. The learned Assistant Government Pleader points out that initially notice was issued to the petitioner on 08.10.2004 for payment of entertainment duty of Rs. 4,03,442/-. The petitioner challenged the said before the Appellate Authority. The appeal is dismissed. Revision filed by the petitioner is also dismissed. The petitioner filed writ petition against the said orders. The writ petition is dismissed for non prosecution.

The petitioner had deposited an amount of Rs. 78,721/- out

2 wp 10791.19 of Rs. 4,03,442/-. The instant notice is for remainder of the amount.

As earlier proceedings filed by the petitioner challenging notice dated 08.10.2004 are final, present writ petition is not maintainable. The petitioner may take steps to revive the earlier writ petition, if permissible in law.

In view of the above the writ petition is disposed of. No costs.
