By the present application, the applicant-wife seeks transfer of proceedings being Hindu Marriage Petition No.92 of 2015, initiated under Section 9 of the Hindu Marriage Act for restitution of conjugal rights from the Court of Civil Judge Senior Division, Ambajogai to Family Court, Nanded.

Learned Counsel appearing on behalf of respondent submits that respondent shall withdraw the said proceedings within three weeks from today, by taking out appropriate application before the said court at Ambajogai. If such application for withdrawal is taken out, the same be granted by learned Civil Judge Senior Division, Ambajogai. 3.

In view of above statement, the present application has rendered infructuous and stands disposed of accordingly. (NITIN W. SAMBRE, J.) amj
