The applicants apprehend their arrest in connection with Crime No. 252 of 2022 registered with Murum Police Station, District Osmanabad for the offences punishable under sections 188, 272, 273, 328 of the Indian Penal Code and section 59 of Food Safety and Standards Act.

Heard the learned advocate for the applicants and the learned Additional Public Prosecutor for the respondent - State.

In the FIR, it is alleged that on 30/07/2022, vehicle Innova car bearing No.MH 12/D 5117 was intercepted and banned articles i.e. Hira Pan Masala etc. were found in the said

912-ABA-1281-22 vehicle. Two persons from the car were arrested. During the course of interrogation, name of the applicants have surfaced. It is alleged that applicant No.1 is the owner of the said vehicle. Applicant No.2 had supplied the banned articles. Perusal of investigation papers show that, prima facie, the applicants are involved in the offence.

Though interim protection was granted to the applicants, the investigating officer has submitted that the applicants are not co-operating in the investigation. 5.

In that view of the matter and considering the fact that custodial interrogation of the applicants is necessary for effective investigation, the applicants do not deserve discretionary relief.

The application is therefore rejected.

7.

Interim protection stands vacated.
