This is an application for bail under Section 439 of Code of Criminal Procedure. The applicant has been arrested in connection with Crime No. 393 of 2022 registered with Sadar Bazar Police Station, Dist. Jalna for the offences punishable under Section 307 read with Section 34 of the Indian Penal Code.

Heard. Perused the First Information Report ("F.I.R.") and related police papers.

After having heard learned counsel for the applicants, the Court expressed disinclination to grant bail to Applicant No.1 - Ravi Hiralal Chaudhari at this stage, since the offence did take place in May 2022. Learned counsel for the applicants, therefore, came around to seek withdrawal of application of Applicant No.1 with liberty to move for bail before the trial Court after a period of four months. Applicant No.2 - Sachin Rameshwar Dongare has not been attributed with any offence. The Court is, therefore, inclined to grant him bail.

In view of above, the application deserves to be allowed. Hence I pass the following order :-

ORDER

(I) Bail application of Applicant No.1 - Ravi Hiralal Chaudhari stands disposed of as withdrawn with liberty to move for bail before the trial Court after a period of four months. (II) Applicant No.2 - Sachin Rameshwar Dongare be released on bail, in connection with Crime No. 393 of 2022 registered with Sadar Bazar Police Station, Dist. Jalna for the offences punishable under Section 307 read with Section 34 of the Indian 2 / 3

Penal Code, on executing P.R. Bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand) with one surety in the like amount. (III) He shall not tamper with the prosecution evidence. (IV) Bail application stands disposed of accordingly. ( R.G. AVACHAT, J. ) SSD 3 / 3
