Heard learned Advocates for the parties. It is case of the petitioner that he is not considered as a trained teacher prior to 1971. The petitioner joined services in 1962. Though he was trained teacher, he was given salary of untrained teacher. He ought to have been given pay-scale of Rs. 115-4-135-5-180-6-210 as on 01.04.1966. However, same is not done. It is also further case that on 02.05.1997 he was shown as trained teacher and pay-scale was accordingly made applicable. However, no effect was given to that order and no implementation was done. He therefore submits that he should be place in pay-scale of Rs. 115-4-135-5-180-6-210 from 01.04.1966.

Learned Advocate for the respondent - Zilla Parishad submits that when the petitioner was appointed, he was having qualification of SSC only. In 1971 he acquired qualification of D.Ed. It is thereafter he is given pay-scale of trained teacher. His earlier representations have already been considered and conscious decision is taken.

Directing reverification would be only repeating the same exercise, which is already done. No material is produced on record to show that on what basis petitioner should be granted pay-scale of trained teacher from 1966. This Court finds that at one point of time in 1997, the petitioner was shown as trained teacher and benefit was given from 1966, in the pay-scale of Rs. 115-4-135-5-180-6-210. There is some record showing that representation was considered for giving pay-scale from 01.04.1966.

This Court, therefore, finds that this petition can be disposed off by directing to verify the record. If Education Officer finds that the petitioner is entitled to get pay-scale from 01.04.1966, same shall be done. If it is found that there is no material to support the claim of the petitioner, respondent No.4 is free to refuse the said proposal. Said exercise shall be completed within two months from today. 05.
