The petitioner is praying for allotment of land to the extent of 15 Hectares from Gat No.230 of village Kusumbe, Jalgaon, for housing purposes.

Writ Petition No.4099/2002 was presented on behalf of the petitioner, making a similar request. During continuance of the said petition, a statement was made on behalf of the Collector that land to the extent of 4 Hectares is available and the same can be allotted to the society. The statement was accepted and direction was issued to allot the land on fulfillment of procedural formalities. The present petitioner is now coming up with a case that land to the extent of 15 Hectares is available and the same be allotted in favour of the petitioner.

The petitioner does not have any vested right to claim land to the extent of 15 Hectares.

It would be open for the petitioner to pursue his claim for allotment of 4 Hectare of land to the Collector. 4.

In our view, no directions need to be issued in this matter. The Writ Petition is devoid of substance and the same stands rejected.
