After this matter was heard for some time, learned Advocate for the petitioner submits on instructions that the Petitioner desires to withdraw this petition. However, some time be granted to deposit the amount as is directed by the learned Additional Sessions Judge. It is pointed out that Rs. 50,000/- (Rupees fifty thousand) have been deposited in the Appellate Court on 09.10.2015. 2.

Learned Advocate for the Respondent No.2 submits that the atu/June.2016

Cri.WP.No. 1213.15.odt impugned order is dated 25.08.2015. It is practically for almost 11 months that the order has not been complied with. He, therefore, opposes a longer duration for depositing the amount as is directed in the impugned order.

In the light of the above, this Criminal Writ Petition is disposed of as withdrawn. The petitioner shall deposit the remaining Rs. 50,000/- (Rupees fifty thousand) within a period of THREE WEEKS from today. Needless to state, the learned Additional Sessions Judge, Aurangabad is at liberty to proceed with Criminal Appeal No.128 of 2015.
