It is a case of rival F.I.Rs. arising out of one and the same incident. Although, initially offence punishable under Section 307 of the Indian Penal Code was registered, on investigation the charge-sheet has been filed for offence punishable under Section 324 and allied offences. 2.
The parties have arrived at settlement. They have filed their affidavits giving express consent to allow these applications. In view of the same, we allow both the applications in terms of prayer clauses B and C in respective petitions, on condition to deposit Rs.30,000/- (Rupees Thirty Thousand) by all the petitioners in both the petitions to Advocate' s Association Bar Library, High Court, Aurangabad. 3.
