Mr. Thombre and Mr. Jarare, learned Advocates for the petitioner submit that the petitioner has been awarded degree of B.Sc. Agriculture by respondent No.3 - University. The petitioner has completed the course in Marathi medium. The Maharashtra Public Service Commission (MPSC) had invited applications for the post of Agriculture Officer and Agriculture Assistant. The Notification for holding preliminary exam specifically
( 2 ) states that the exam would be conducted in Marathi and English languages; whereas the Notification dated 24.07.2018 issued for conducting final exam states that the final exam will be conducted only in English language. The students who have completed the course from Marathi medium would be at disadvantage to compete with those from the English medium. The respondents be directed to hold final exam in English language as well as in Marathi language. The work of Agriculture Assistant is normally in the villages and the same has to be performed in regional language. Almost half of the students competing would be the students who have completed the course from respondent No.3-University. If the respondents are not in a position to conduct exam in both languages, then they may be directed to postpone the exam.

Mr. Tambe, learned AGP, on instructions, submits that 5976 candidates are eligible to appear for final exam. The question papers are set and have been forwarded
( 3 ) to the MPSC. The Notification is issued on 24.07.2018. The petitioners had not assailed the Notification immediately. The question papers are objective. As such, the problem of language would not arise. Since 3-4 years the MPSC is holding final exams for the post of Agriculture Assistant in English language.

No doubt, the submissions made by the petitioner are required to be considered and cannot be brushed aside without debate. Final exam is to be held on 08.09.2018 and almost 5976 candidates are qualified for the said exam. It is submitted that the question papers are set and have been sent to the MPSC. It would not be possible at this stage to accede to the request of the petitioner. 4.
The matter is alive before the Maharashtra Administrative Tribunal. The grievance of the petitioner can be considered by the Maharashtra Administrative Tribunal.

Considering that the exam is scheduled tomorrow viz. 08.09.2018, no relief can be granted to the petitioner. The writ petition, as such, is disposed of. No costs.
