PER COURT:

1] On 13.1.2016, learned AGP was directed to take instructions, as to whether the Karkhana has gone in liquidation and about the status of the assets of the Karkhana. Learned AGP on instructions submits that the liquidator has been appointed upon the said Karkhana and as per the record Rs.9 Crore 4 lacks is the amount of wages payable. Mr. Choudhari, learned counsel submits that the provident fund authority has recovered the amount of provident fund dues in the year 2012 and the same is paid to the labourers/employees.

2] As the Karkhana has gone in liquidation, it will be for the liquidator to adjudicate the claims and distribute the amount as per the priority claims. The petitioners may approach the liquidator in this regard as now the liquidator has already been appointed. If the claims are made by the petitioner, liquidator shall consider the same on its own merit.
