Heard learned counsel for the applicants and learned AGP for respondents No.1 and 2. Despite service of notice, no one else appeared on behalf of respondent No. 3. Acquiring Body. Perused the application.

The present application is filed by the applicants seeking condonation of 122 days delay caused in filing the first appeal against the impugned award passed by the Civil Judge, Senior Division, link Court at Mukhed in LAR No.221 of 2007. 3.

In view of nature of subject-matter and reasons mentioned in the application, there is no impediment to condone the delay. Hence, application deserves to be allowed.

Accordingly, the civil application stands allowed in terms of prayer clause "B". The delay of 122 days caused in filing the appeal against impugned judgment and award is hereby stands condoned. The Registry to take requisite steps for further process. The civil application stands disposed of accordingly.

On registration of appeal, issue notice to respondents. Learned AGP waives service of notice on behalf of respondents No. 1 and 2.
