Present application has been filed for withdrawal of amount. Amount of Rs.5,71,532/- has been deposited in this Court by the insurance company. Learned Advocate appearing for the insurance company submits that the appeal has been filed on the ground that the driver of the offending vehicle was not holding valid and effective driving licence on the date of the accident.

Taking into consideration the fact that, at present, the liability has been fastened on present respondents including the insurance company, case is made out for partial withdrawal of the amount. Hence,

1030-ca-11727-19 (withdrawal).odt applicants are allowed to withdraw amount of Rs.1,00,000/- each subject to filing an undertaking within a period of eight weeks that they would make the said amount good, if directed at the time of final disposal of the appeal.
