2025:BHC-AUG:31550-DB
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD WRIT PETITION NO. 10481 OF 2025 X
VERSUS
The State Of Maharashtra Through Secretary And Others Mr. A. A. Yadkikar, Advocate for petitioner Mr. R. B. Dhaware, AGP for respondent-State
CORAM
: Smt. Vibha Kankanwadi & Hiten S. Venegavkar, JJ.
DATE : 17th November, 2025 PER COURT :- 1.
Learned Advocate for the petitioner places on record the pursis along with photocopy of the record regarding birth of child on 08.11.2025. The pursis is taken on record by marking Exhibit 'X'. Learned Advocate for the petitioner submits that now the petitioner does not want to proceed with the matter and she want to keep the child and she look after a child happily.
2.
We are happy to note that the mother has accepted the child and want to do everything for upbringing of the child. We hope and trust that she would keep her motherhood alive all the time and look after the child happily. We have also taking note of the fact that basically petition was for termination of pregnancy. It was belated. The earlier bench in order dated 15.09.2025, had taken note of the fact that during the 2-WP-10481-2025.odt
course of hearing of respondent No. 6 had joined the proceedings through video conferencing and he made a statement that he has no objection for Prayer Clause B2, has added by way of amendment, being granted. Prayer Clause B2 was to permit the petitioner to hand over the child to Non-Government Organization for the welfare of the child and it was also contain stipulation that the consent of the respondent No. 6 may be dispensed with. Here, it appears that when the respondent No. 6 had joined the proceedings through video conferencing, he has not denied the paternity and, therefore, our observation as regards maintaining the child is concerned, it is not covering the financial aspect but it is restricted to upbringing of child as a mother by keeping the child with her.
3.
The parties would be at liberty to exercise their rights separately.
4.
We honor sentiment of the petitioner and allow the petition to be withdrawn.
5.
Petition stands dismissed as withdrawn.
