O R D E R

(14 th DECEMBER, 2024) 1.

This appeal is placed before us in today's National Lok Adalat. Learned Advocate Mr. Anand Dale h/f Mr. Rathi Swapnil S. is present on behalf of the appellant/ Shriram General Insurance Company. Mr. Mr.Ram Shinde, learned Advocate is present on behalf of respondent N. 1/Original Claimant.

The learned Advocates for both the parties submit that they have amicably settled the lis and accordingly placed

on record compromise terms. The compromise terms are marked as Article "X" for the purpose of identification. 3.

The amount of compensation has been deposited by the Insurance Company in this Court, out of which the amount of Rs. 1,00,000/- (Rs. One Lakh Only) is to be refunded to the Insurance Company, without interest and the rest of the amount is to be given to the Original Claimant/Respondent No. 1, alongwith accrued interest.

The amount of Rs. 7,50,000/- (Rs. Seven Lakhs and Fifty Thousand Only) has already been withdrawn by the Original Claimant/ Respondent No. 1. Whatever, amount is disbursed to the Original Claimant is without reference to this Court.

As per the terms of compromise respondent No. 1/ the Original Claimant has entitled to withdraw the balance/rest of the amount along with interest accrued thereon in terms of compromise pursis.

The Member, Motor Accidents Claims, Tribunal,

Latur be informed accordingly.

7.

The Court fee refund certificate be issued as per the provisions under the Maharashtra Court Fees Act, 1959. 8.

The First Appeal and pending Civil Application, if any, stand disposed of.

9.

The award be drawn up accordingly.
