ORDER

This matter is not on board. However, at the request of the appellant, taken on board. The appellant through representative Mr. Dinesh S. Bankar, Assistant Manager with Advocate Mr. Usmanpurkar is present. Original complainant/respondent no.1 is present through his Advocate Mr. Sohail Shaikh h/f Mr. Shaikh Mazhar A. Jahagirdar. 2.

Both parties filed the compromise terms on record, which are marked as Exhibit `X'.

First Appeal as well as Cross-Objection is disposed of in terms of the compromise.

As per the the compromise terms, Insurance Company is entitled to withdraw an amount of Rs.50,000/-, out of the amount which is deposited in this Court and the remaining amount along with acrued interest be permitted to withdraw by the claimants/respondents, without any reference to this Court.

Civil Application, if any, be disposed of.

Court fees be refunded as per the rule.
