The learned counsel appearing for the parties have not disputed that the question involved in this petition has already been considered and decided by the Division Bench of this Court on 16th August 2017 in Writ Petition No. 10185/2017 [The Jawaharlal Nehru Institution of Education and Anr. Vs. The State of Maharashtra and Ors.].

In view of the aforesaid, we allow this petition by setting aside the impugned order dated 7th August 2017. The necessary consequences as a result of quashing of the order shall follow. It would be open for the respondents to take necessary steps as permissible in law and in tune with the procedure that has been prescribed.
