It is an application for stay moved by the applicant appellant.

Heard Mr. Nagode, learned counsel for the applicant. Mr. R.M. Biniwale and Mr. D.J. Donde, learned counsel for respondent nos. 1 to 5 remained absent, when matter is called out. Perused the affidavit-in-reply filed by the respondents. Perused the impugned judgment and order passed in W.C.A. No. 3 of 2016 dated 09.11.2016.

It is revealed during the course of argument that the applicant / appellant has deposited the entire decretal amount with the Labour Court at Aurangabad. Mr. Nagorde, learned
5-ca-2869-21 counsel for the applicant / appellant invited my attention to the receipt to that effect, which is placed on record with the stay application.

Having regard to the entire decretal amount deposited by the applicant / appellant, it is necessary to grant stay to the operation and execution of the impugned order passed in W.C.A. No.3 of 2016 dated 09.11.206.
O R D E R
(i) The application is hereby allowed.
(ii) The operation and execution of the impugned judgment and order passed in W.C.A. No. 03/2016 dated 09.11.2016 by the Commissioner for Workmen Compensation and Judge, Labour Court at Aurangabad is hereby stayed till final decision of the appeal.
(iii) Inform the concerned Court accordingly.
