This Court has gone through contentions made in the matter. In ordinary course the Magistrate passes the order for recovery of arrears of maintenance as provided in the Code of Criminal Procedure. Direction is claimed against the Magistrate to pass such orders. This Court cannot do it as the Magistrate work is provided in Cr.P.C. and he needs to be satisfied that he needs to pass some orders. This Court cannot give such direction to the Magistrate. Nobody is present for the petitioner. The matter was filed in 2019, but no interest was shown to prosecute the matter and circulation was not obtained. In view of this circumstances, the matter is disposed of as dismissed.
