We have heard learned Counsel for the petitioner and learned Counsel for the respondents. Affidavit is filed on behalf of respondent Nos.1 and 2 by the Dy. Director (E) in the office of All India Radio, Aurangabad. Para 9 of the said affidavit reads as under :- "9.

I say and submit that, in view of above circumstances the petitioner could not be given compassionate appointment. Moreover, after rejection of request, petitioner approached before this Hon'ble Court after four years. However, in view of latest OM No.14014/3/2011Estt(D) dtd.26.07.2012 of DOPT, the limitation

( 2 ) wp9845.14 for consideration upto 03 years as contained in OM dtd.5-5-2003 has been withdrawn. The case of the petitioner may be considered in the next meeting of Screening Committee as and when held. Therefore, such belated claim may not be entertained. I, therefore, pray for dismissal of the Writ Petition."

In view of the fact that in the affidavit it is stated that the case of the petitioner will be considered in next meeting of Screening Committee as and when held, we are not entertaining present writ petition on merits. The respondents shall consider the same.

The writ petition is disposed of. No costs.
